Contacted by phone a few hours after the test, Zahn is genuinely stumped – and surprised. He said the magnet shouldn’t cause acceleration. “It’s an unusual phenomena I wouldn’t have predicted in advance. But I saw it. It’s real. Now I’m just trying to figure it out.”

There’s no talk of perpetual motion. No whisper of broken scientific laws or free energy. Zahn would never go there – at least not yet. But he does see the potential for making electric motors more efficient, and this itself is no small feat.

“To my mind this is unexpected and new, and it’s worth exploring all the possible advantages once you’re convinced it’s a real effect,” he added. “There are an infinite number of induction machines in people’s homes and everywhere around the world. If you could make them more efficient, cumulatively, it could make a big difference.”

A copyright violation claim by the Church of Scientology against the posting of one of its videos to YouTube has prompted a full-on assault by a group calling itself Anonymous.

The video, in which Tom Cruise proclaims, in part, that Scientologists are the only experts on the mind, was pulled by YouTube over the weekend at the request of the Church of Scientology as part of a long-standing effort to keep copyrighted material from appearing on the Internet. Other sites have since posted the Cruise video in full.

In response to the take-down of the Cruise video, a group of vigilantes–calling themselves Anonymous, or Anon–have retaliated against what they consider to be Internet censorship. The group includes computer experts capable of Internet mischief. In recent days, local chapter sites for the Church of Scientology have been defaced, and in some cases denial of service attacks have also prevented access to the same sites. Real-world attacks have included fax-spamming those same offices.

A Minnesota couple is worried about their American granddaughters after Italian authorities placed the children in foster care while their mother, an Air Force staff sergeant, was on a mission last week.

On Oct. 13, police in Pordenone, Italy, took away Staff Sgt. Kris Wylie’s daughters — Leighlora, 7, and Lillian Ann, 5 — from the custody of her Italian fiance at their off-base home while Wylie was on a mission outside of Italy. They were put in the Italian version of Child Protective Services.

“You think of the children themselves in a strange place with strangers,” said Bob Benson, of White Bear Lake, Minn., a suburb of St. Paul. “Fortunately they can speak the language, but they aren’t with their parents; they were just ripped away, no reasons given, no paperwork, no nothing.”

Italian authorities have charged Wylie, 28, with three counts connected to the maltreatment of children, according to Tech. Sgt. Michael O’Connor at the Aviano Air Force Base in Aviano, Italy.

“Her squadron leadership is in full support of her and believe the allegations to not be true,” O’Connor said.

Benson and his wife, Marcia, learned of their grandchildren’s plight from their daughter on Wednesday. “All we know is that our grandchildren are missing and our daughter is telling us that she’s been charged with abandonment,” Bob Benson said.

Last week, Radiohead released their latest album, In Rainbows, for free, asking fans to pay whatever they liked for the full length downloadable work. To me, the writing on the wall was clear. Radiohead wasn’t the first to give away their music, and they won’t be the last. I declared the era of free music to be upon us and the album as a saleable item dead. Many thought I was right.

A week later, the “sales” numbers for In Rainbows are starting to leak. By my calculations, Radiohead made out with a ton of money.

According to a source close to the band, In Rainbows has “sold” approximately 1.2 million copies as of October 12th. In comparison, that’s more albums sold in the first week than Radioheads’ last three releases combined. According to an Internet poll of 3,000 people, the average price paid for In Rainbows was $8. If these numbers are accurate, Radiohead has made close to $10 million in one week on this album alone.

An example would be a television show uploaded to youtube.com without permission from the production company. The right to sell an item that has been legally purchased is protected under copyright law. The first sale doctrine allows an individual to transfer (i.e. sell, giveaway etc.) a lawfully made copy of an item without permission once it has been obtained. The doctrine has been part of US law since the Supreme Court recognized it in 1908 and covers everything from books and DVDs to clothing and automobiles.

AutoDesk is using the Digital Millennium Copyright Act to have legal copies of their software removed from eBay so they can sell more new copies. The latest version of AutoCAD software is around $4000.00 a copy. AutoDesk’s Lawyer, Andrew S. Mackay states “AutoCAD software is licensed, not sold and that license is not transferable.” AutoCAD software is available for purchase at most major software retailers. There is no indication your purchase would be different from any other until you get it home and open the box. There is a piece of paper tucked inside that says it is a licensing agreement with the statement “by opening the sealed software packet(s), you agree to be bound by the terms and conditions of this license agreement”. This is called a “shrink wrap” contract. It cannot be read until you open the package which according to the contract constitutes agreement. US courts have not held a “shrink wrap “ contract to be valid. Furthermore the Digital Millennium Copyright Act is only intended to enforce copyright violations, not breach of contract.

The lawsuit also alleges perjury since the notice that was sent to eBay is required to be signed under penalty of perjury and fraud. Using illegal means to make a legal gain (i.e. sell more new copies) is a civil definition of fraud. AutoDesk’s attorney Andrew S. Mackay is currently under investigation (# 07-24456) by the California State Bar Association for his actions in this matter.

Timothy S. Vernor, a Seattle resident, filed the suit when his eBay account was suspended after AutoDesk sent eBay five takedown notices over a two year period. For seven years he has made his living selling used items on eBay under the user name happyhourcollectables and has positive feedback comments from over ten thousand satisfied customers posted on the eBay site. He says “I tried to reason with (AutoDesk) but they just would not take me seriously until I filed the suit.”
